What are the advantages of taking my complaint to arbitration?

Arbitration has many advantages including:

Speed – arbitration is usually far quicker than it takes for a court to reach a decision. Preparing documents is also less demanding

Privacy – arbitration is confidential between the claimant and respondent. ABTA may analyse the arbitration awards in order to monitor the effectiveness of the scheme

Convenience – dealt with on a documents only basis, therefore you do not attend a hearing.

The scheme is administered by an external organisation that employs qualified arbitrators. This means that your claim will be considered in the same way as it would in a court of law.

The main difference is that the arbitrator will assess your claim on documentation only, which may include video or photographic evidence. Basically, the arbitrator will review your claim, the company’s defence and issue a legally binding decision – the award.
