I’ve taken my holiday dispute to Arbitration and was unsuccessful, what can I do now?

There are two routes for challenging the outcome of your Arbitration process.

1. You can appeal through the High Court, within 28 days of receiving the Arbitration award.

2. You can request an appeal under the ABTA Arbitration scheme appeals procedure. You must apply for appeal within 28 days of receiving the award.

These deadlines are strictly enforced and if you don’t apply in time you’ll lose the right of appeal. There is no other way to challenge the outcome.

You may not like the outcome but remember, that doesn’t mean it is wrong by law.

ABTA advice
If you’re not happy about the award think carefully as to whether you wish to appeal the decision. Take into consideration the cost of appealing to the High Court.
