Consumer Protection Consultations
Three major consultations are taking place in 2009-10 which will decide the future of consumer protection in the travel industry. Financial protection for consumers' travel arrangements is a major element in all three consultations.
The European Commission is reviewing the Package Travel Directive (PTD) and consulting on a Europe-wide basis. This consultation considers, among other things, the scope of financial protection, the provision of information, and where responsibility lies for the consumer's travel arrangements. Consultation period: 26 November 2009 to 7 February 2010
The Department for Transport (which is responsible for the CAA, which in turn is responsible for the ATOL regulations) is consulting on the ATOL scheme in the UK. This consultation considers, among other things, the scope of financial protection for consumers' travel arrangements. Consultation period: 10 December 2009 to 11 March 2010.
The European Commission is consulting on air passenger rights, including protection against airline failure, on a Europe-wide basis. This consultation considers, among other things, loss or damage to baggage, denied boarding, persons with reduced mobility, and airline insolvency. Consultation period: 15 December 2009 to 1 March 2010.
These consultations could change the shape of the travel industry, affecting not just the way the industry does business but also the business models that individual travel companies use.

Are these consultations relevant to my business?
Changes to the ATOL scheme and the Package Travel Directive could change the shape of the travel industry, affecting not only the way the industry does business, but also the business models that individual travel companies use. You’re unlikely ever to have another opportunity to contribute to three such important consultations.
What opportunities are offered by reform?
Because of changes in the way people book and the increase in DIY holidays, the question of financial protection has become very confusing, as legal definitions have become blurred. Most travellers are no longer automatically protected, and are unaware that this is the case. These consultations offer an opportunity to simplify the regulations, to extend financial protection for consumers, and to level the playing field with the airlines.
What's happening with the consultations and can I get involved?
